{"id":10602,"date":"2016-03-02T18:36:35","date_gmt":"2016-03-02T18:36:35","guid":{"rendered":"https:\/\/www.vailvalleypartnership.com\/?p=10602"},"modified":"2016-03-02T18:36:35","modified_gmt":"2016-03-02T18:36:35","slug":"hosptial-provider-fee","status":"publish","type":"post","link":"https:\/\/www.vailvalleypartnership.com\/2016\/03\/hosptial-provider-fee\/","title":{"rendered":"Hosptial Provider Fee"},"content":{"rendered":"<h4 class=\"null\">Two Former Gubernatorial Legal Counsels Issue Bipartisan Opinion about Hosptial Provider Fee<\/h4>\n<p>Last week, two attorneys, Jonathan Anderson and Trey Rogers, both of whom served as Colorado gubernatorial legal counsels, issued a\u00a0<a href=\"http:\/\/cochamber.com\/wp-content\/uploads\/Memo_Provider-Fee-Enterprise_FINAL.pdf\" target=\"_blank\">legal memo<\/a>\u00a0that said that the legislature could convert the hospital provider fee (HPF) into a state enterprise, which would free up hundreds of millions of dollars for transportation, education and State capital construction.<\/p>\n<p>Some additional, critical factors in this important debate will be the opinion of the State\u2019s top legal official and the state\u2019s economic-and-tax-revenue performance.<\/p>\n<p>Governor John Hickenlooper, a Democrat, has asked\u00a0<a href=\"http:\/\/www.coloradoattorneygeneral.gov\/\" target=\"_blank\">Republican Attorney General Cynthia Coffman<\/a>\u00a0for an opinion on this matter.<\/p>\n<p>\u201cAnother factor in this debate will be the March economic-and-revenue forecasts by the Office of State Planning and Budgeting and the legislature\u2019s economists,\u201d said Loren Furman, CACI Senior Vice President, State and Federal Relations, &#8220;because the forecasts could affect the amount of projected TABOR surplus, which will be politically important in the discussions.\u201d<\/p>\n<p>Under TABOR, a\u00a0<a href=\"https:\/\/www.colorado.gov\/pacific\/sites\/default\/files\/Enterprise%20Issue%20Brief4915143536.pdf\" target=\"_blank\">state enterprise<\/a>\u00a0is defined as \u201ca government-owned business authorized to issue its own revenue bonds and receiving under 10% of annual revenue in grants from all Colorado state and local governments combined.\u201d<\/p>\n<p><a href=\"https:\/\/www.hollandhart.com\/jmanderson\" target=\"_blank\">John Anderson, a Partner with Holland and Hart LLP<\/a>, served as chief legal counsel to then-Republican Governor Bill Owens.<\/p>\n<p><a href=\"http:\/\/www.lrrc.com\/Rogers\" target=\"_blank\">Trey Rogers, a partner with Lewis Roca Rothberger Christine LLP<\/a>, served as chief legal counsel to then-Democrat Governor Bill Ritter.<\/p>\n<p>Click here for\u00a0<a href=\"http:\/\/cochamber.com\/wp-content\/uploads\/HPF-Legal-Memo-Release_FINAL.pdf\" target=\"_blank\">complete details<\/a>.<\/p>\n<p>Information courtesy of Colorado Association of Commerce &amp;
